Terms of Service

Effective date: October 28, 2026 Provider: ServicemanRecords (operated by Robert Hopkins, a sole proprietor in California, USA) ("we", "us") Contact: scdevonprop@gmail.com

1. The agreement

These terms are a contract between you and us about your use of ServicemanRecords (the "Service"), including the website, the web app (PWA) and any mobile app. By using the Service, you agree to them. If you use the Service for a business, you promise you can agree for that business. If you do not agree, do not use the Service.

2. Business use only; who can use it

The Service is made for people who run or work in trade and home-service businesses, to use for business purposes. It is not meant for personal, family or household use. You must be at least 18. The Service is for businesses in the United States for now (see Section 19).

3. What the Service is, and what it is not

ServicemanRecords helps you record jobs, photos, quotes, invoices, hours and tax set-aside estimates. It is bookkeeping and organizing help. It is not legal, tax, accounting, payroll, insurance, licensing or contracting advice, and it does not file taxes, run payroll, or give you a legal opinion.

4. Early preview; features that are not available yet

The Service is currently an early preview. Some features are not built yet and are marked "coming soon" in the app and on the website: taking card or bank payments, sending texts or emails from the app, syncing with accounting software, online booking, accounts and cloud backup, and paid plans and billing. "Recording a payment" only records a payment you already received. We may add, change or remove features.

5. Free trial, plans and billing

5.1 Today. Billing is not live. Nothing is charged, and you cannot be charged, because the app has no way to take a payment. The app shows a 30-day trial counter; after it ends the app keeps working and you can still view and export everything. The sections below (5.2 to 5.9) describe how paid plans are planned to work. They take effect only if and when billing launches, and we will ask for your agreement first. Prices are plans and may change before then.

5.2 The free trial (when billing launches). You get a 30-day free trial with no card required. We will not charge you at the end of the trial unless you choose a paid plan and agree to it. If you do nothing, no charge is made. When the trial ends, we will not delete your data. You can still export it using "Download all my data". When accounts exist, we plan to email you before the trial ends to tell you the date, the price and how to choose or skip a plan.

5.3 The paid plan (when billing launches). The standard plan is planned at $29 per month for your whole shop, for the people who work for your business and use the Service for it ("fair use": not for resale or for other businesses). It is billed monthly, in advance, and renews automatically each month until you cancel. You will see the price, the monthly renewal and how to cancel on the screen right next to the button where you agree, and we will email you a confirmation that includes the same information.

5.4 Founding price (when billing launches). The first 200 shops that sign up for a paid plan are planned to pay $19 per month for the first 12 months. After that the plan automatically becomes $29 per month unless you cancel. We will remind you by email 3 to 21 days before the founding price ends (we aim for about 14 days before), with the new price, the date and how to cancel.

5.5 Cancelling. When billing launches, you will be able to cancel at any time online in the app (one clear button, no phone call needed), or by emailing scdevonprop@gmail.com. If you cancel, your plan stays active until the end of the month you already paid for, and we do not charge you again. Except as stated here or required by law, payments are not refundable.

5.6 Price changes. If we change the price or other key terms of a plan you have already agreed to, we will email you at least 30 days before the change takes effect, with the new price and how to cancel. If you do not want the change, cancel before it starts.

5.7 Taxes. Prices do not include sales, use, value-added, GST/HST/QST or similar taxes. Where we are required to collect them, we will add them to your invoice.

5.8 Payment problems. If a payment fails, we will tell you and may try again. If it keeps failing, we may pause your paid features until you update your payment method. We will not delete your data for a failed payment without warning you first.

5.9 App stores. If we ever sell plans through Apple or Google, their billing terms also apply to purchases made through their stores, and you would manage and cancel those subscriptions in your store account. We would still show the price, renewal and cancellation information described here.

6. Your content and data

7. Acceptable use

Do not use the Service to: break the law; send spam or unlawful messages (including texts or emails to people who have not agreed to receive them); harass, defraud or harm anyone; upload content you do not have the right to use or that infringes others' rights; try to break, overload, probe or reverse engineer the Service or get around limits; copy, resell or offer the Service to others without our written permission; or use it to build a competing product. We may suspend access for serious or repeated violations (see Section 13).

8. Your responsibilities

You are responsible for: the accuracy of your quotes, invoices, taxes, hours and records; your licenses, permits, insurance, taxes and payroll; your contracts and communications with your customers and employees; keeping your device and login secure; and complying with the laws that apply to your business.

9. Third-party links and services

The Service may link to other sites (for example a map when you tap an address, or a government website). We do not control them and are not responsible for them. Competitor and vendor names mentioned in the Service (for example when you import a file exported from another system) belong to their owners. We are not affiliated with, endorsed by or sponsored by them.

10. Feedback

If you send us ideas or suggestions, we may use them without owing you anything. We will not publish your name or your business information without your permission.

11. Our rights

We own the Service, its software, design and brand (ServicemanRecords and related logos), except for Your Content and third-party materials. You get a limited, non-exclusive, non-transferable right to use the Service for your business under these terms.

12. Referral credits

There is no referral program today. If we start one, we will post its rules first. They will include that you must tell the people you refer that you get a credit when you share your link, and that we do not reward ratings or reviews.

13. Availability, changes and ending

We try to keep the Service available, but we do not promise it will be uninterrupted or error-free, and it is an early preview. We may change or end features; for changes that materially hurt you, we will give notice where practical. You can stop using the Service at any time. We may suspend or end your access if you break these terms, with notice where practical. If we end the Service for our own convenience while you have prepaid fees, we will refund the unused part of the paid period. Sections that should survive ending (such as 6 data export responsibilities, 14 to 18) will survive.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR NEEDS, THAT CALCULATIONS ARE CORRECT FOR YOUR SITUATION, OR THAT YOUR DATA WILL NOT BE LOST. THE SERVICE DOES NOT PROVIDE LEGAL, TAX, ACCOUNTING OR PAYROLL ADVICE. Some places do not allow some of these disclaimers, so some may not apply to you.

15. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA OR LOST BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100 IF YOU PAID NOTHING. These limits do not apply to liability that cannot legally be limited, including for our fraud, willful misconduct, or violations of law, or for anything that California law (including Civil Code section 1668) does not allow us to exclude.

16. Your promise to cover certain claims

To the extent allowed by law, you will cover claims against us that come from Your Content, your breach of these terms, or your violation of law (for example, entering customer data you had no right to use). We will tell you promptly and you may control the defense, but we may take part at our own cost.

17. Governing law and where disputes go

These terms are governed by California law, without regard to conflict-of-law rules, except where your local law requires otherwise. If we cannot resolve a dispute informally, either of us may bring it in the state courts located in San Mateo County, California. Before suing, please email scdevonprop@gmail.com with a description of the problem and give us 30 days to try to fix it.
